Terms and Conditions for this Voilà Referral Program (“Referral Program”) 

The Referral Program offered by Voilà.ca (“Voilà”) has been created to reward our customers ( “Referrer,” “Participant”), for recommending Voila to friends and family who become Voilà customers 

Voilà, is owned and operated by Sobeys Capital Incorporated (the “Company”, “Sobeys”, “we”, “us” or “our”). 

The following Referral Program terms and conditions contain important information about the Referral Program, so please read them carefully. These Referral Program terms and conditions are a binding agreement between Participant and Sobeys and will govern your participation in any and all Referral Program offers. By participating in the Referral Program, Participant agrees to be bound by these terms and conditions, Voilà’s Privacy Policy, and Voilà’s Terms and Conditions. Participant is not authorized to participate in the Referral Program if Participant does not agree to these Referral Program terms and conditions in their entirety.

Sobeys reserves the right to modify these Referral Program terms and conditions at any time, at its sole discretion, and without notice to Participant. Participation in the Referral Program is considered acceptance of these Referral Program Terms and Conditions and any modifications which might be made. Sobeys may, in its sole discretion, change, cancel, suspend, or modify any aspect of the Referral Program without notice. Sobeys reserves the right to disqualify any Participant or prospective Participant at any time from participation in the Referral Program. 

To be eligible for the Referral Program, the Referrer must refer a referred contact (“Referee” or “Participant”) who is not an existing customer of Voilà (“Referral”).

An individual can only be nominated for the Referral Program one time. 

This Referral Program is not valid and rewards are not payable for self-referrals.

Sobeys reserves the right to cancel this Referral Program without prior notice in its entirety or for a specific Referrer or Referee at any time for any reason.

All questions or disputes regarding eligibility for the Referral Program will be resolved by Sobeys in its sole discretion.

This Referral Program offer cannot be combined with any other offer. 

How do I refer?

Referrer will receive an invitation email from Voilà to participate in the Referral Program. Referrer will need to register as a Referrer at referral.voila.ca and agree to these terms and conditions before providing your family or friend’s details as requested. Referrer has the option to share the Referral code via email, text, social media, and/or any other media through which the Referrer has the ability to share links.

Can I refer more than one friend or family member?
Yes. There is a limit of 10 friends or family members Referrer can refer per month.

What will NOT be considered a valid Referral eligible for a Referral Reward?

1. When Referrer refers an individual who previously referred Referrer.
2. When Referrer refers themself, refer people Referrer referred previously, or use different email addresses to try to circumvent fraud detection.
3. Sobeys reserves the right to refuse any Referral payout based on findings of its own investigations into suspected fraudulent activity. 
4. When the Referee cancels their first order prior to delivery or curbside pick.

Qualified Referrals 

A Referral will qualify for a Referral Reward when the following process occurs

1. The Referrer shares a Referral link through email, Facebook, or Twitter (or other media through which the Referrer has the ability to share links) with the Referee.
2. If the Referee uses that link and follows the instructions shared by the Referrer and becomes a Voilà customer, therey will then be a qualified Referral.
3. The Referee will receive a Referral Reward. 
4. The Referrer will only qualify for a Referral Reward once the Referee has made their first purchase at Voilà (excluding orders that are cancelled prior to delivery or curbside pick). The Referrer will receive a Referral Reward within forty-five (45) days of the Referee’s first confirmed purchase at Voilà, or such longer time as Sobeys requires to confirm the purchase is in compliance with these terms and conditions

Eligibility 

To be eligible for participation in the Referral Program, the Referrer must be a current Customer of Voilà and must have placed at least one order with Voila. Sobeys reserves the right to find ineligible any Participant in the Referral Program at its sole discretion. 

Rewards  

By making a valid Referral, Referrer will receive a reward and their Referee will receive a reward (each, a “Referral Reward”) to be used toward a Voilà purchase, subject to the restrictions set forth in these terms and conditions. In order to qualify as a valid Referral, Referee must not be an existing customer of Voilà and must be a first-time user of Voilà as a result of the Referral. Referrer can earn a maximum of 10 Referral Rewards from qualified Referrals per month. 

1. 1500 Scene+ Points Referral Reward for Referrer (for you)

Offer valid until June 30, 2024 for orders scheduled for delivery or pick up on or before July 1, 2024. When you spend a minimum of $100 or more on a single transaction (before applicable taxes and charges and after deducting any discounts or coupons), you can redeem a voucher code to receive 1500 Scene+ points. Voucher code must be entered during checkout at voila.ca to redeem. Offer intended for customers with a valid voila.ca account. Limit of one coupon per eligible customer and valid for one-time use. Void if sold, transferred or altered. No cash value. Cannot be combined with any other offer and excludes previous purchases. Scene+ points will be awarded up to 2 weeks after purchase. We reserve the right to rescind the offer, cancel any order or suspend the ability to receive this or any offers from Voilà if we determine, in our sole discretion, there is abuse of the offer or unauthorized or ineligible use of the offer or voucher code. Offer valid only for customers in the voila.ca delivery/pickup area (determined by postal code). This offer is subject to cancellation or modification at our discretion without notice. No base Scene+ points earned. Offer excludes taxes, delivery charges, bill payments, service fees, rental fees, event tickets, gift cards, pre-paid cards, postal products and services, Western Union, McCafe®/Tim Hortons®/Starbucks® products and services in select regions, prescription drugs, non-prescription pharmacy services, liquor and alcoholic beverages, tobacco products, lottery, photo finishing, deposits, environmental charges, fuel and other goods and services which are non-discountable or excluded by law. 2. $20 off Referral Reward for Referee (for your friends and family)

Receive $20 off when you spend $100 or more in a single transaction, before applicable taxes and charges and after deducting any discounts or coupons. Voucher code must be entered during checkout at Voila.ca to redeem. Offer expires June 30, 2024, for orders for delivery or curbside pickup no later than July 1, 2024. Offer excludes delivery or pickup fees and delivery pass subscriptions, gift cards, deposits and environmental charges and any other items not discountable or excluded by law or as we determine from time to time. Offer intended for new customers of Voila.ca only with a valid Voila.ca account. Limit of one Referral Reward per eligible customer and valid for one-time use. Void if sold, transferred or altered. No cash value. Cannot be combined with any other offer and excludes previous purchases. Voilà reserves the right to rescind the offer, cancel any order or suspend the ability to receive this or any offers from Voilà if we determine, in our sole discretion, there is abuse of the offer or unauthorized or ineligible use of the offer or Referral Reward code. CASL Compliance

By sending the Referral link to Referee, the Referrer confirms that: (i) they have a family relationship (means that Referrer is related to the Referee through marriage, common law, or parent-child relationship and has engaged in direct, voluntary, two-way communication with that individual) or personal relationship (means that Referrer engages or has engaged in direct, voluntary, two-way communication with the Referee such that it is reasonable to conclude that Referrer has a personal relationship with Referee based on the nature of the communications) with Referee. If Referrer does not have such a relationship with Referee, Referrer may be in violation of Canadian law and subject to fines and penalties; and (ii) this is the first time Referrer has shared this Referral with Referee. The communication to Referee will be made for the sole purpose of sending an email to the Referee with a link to the Referral Program.

Consent

I consent to the collection, use, and disclosure by Sobeys Capital Incorporated of my personal information in accordance with the Voilà’s Privacy Policy for the purpose of administering this Referral Program, including disclosure to Referral Rock and for the purpose of contacting you with respect to this Referral Program.
